These Terms & Conditions (“Terms”) apply to your use of aquilatyre.com (the “Site”), operated by Aquila Tyre Group (“Aquila”, “we”, “us”). Please read them before using the Site.
By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
If you use the Site on behalf of a company, you confirm that you are authorised to accept these Terms for that company.
You may use the Site to learn about Aquila, our brands and our products, and to contact us about doing business. You agree not to:
Use the Site for any unlawful or fraudulent purpose
Submit false or misleading information, or pretend to be another person or company
Try to gain unauthorised access to the Site, interfere with how it works, or introduce malicious code
Copy or extract substantial parts of the Site, including product data and images, by automated means without our written permission
Use Site content to suggest a partnership, distributorship or endorsement that does not exist
We may suspend or restrict access to the Site at any time without notice.
Product details on the Site, including sizes, load index, speed rating, ply rating, dimensions, tread patterns and images, are provided for general reference. Specifications may change without notice and may differ by market or production batch. Images are illustrative, and availability varies by market.
Before placing an order, confirm current specifications, certification and availability with our sales team.
Always select, fit, inflate and load tyres according to the vehicle manufacturer’s recommendations, the markings on the tyre and local regulations. Content on the Site is not technical or safety advice for any specific vehicle or application.
Nothing on the Site is an offer to sell. Sending an enquiry or a quotation request does not create a contract, and we may decline any request.
Prices, lead times and terms given in a quotation apply only as stated in that quotation and for its validity period.
All sales are governed by the written sales contract, proforma invoice or order confirmation agreed between you and the relevant Aquila company. If those documents conflict with these Terms, those documents take priority.
Distributor, dealer or exclusive territory rights exist only under a signed written agreement with Aquila.
The Site and its content, including text, images, graphics, videos, product data, logos and layout, are owned by Aquila or its licensors and are protected by intellectual property laws.
The AQUILA and MARLIN names and logos are trademarks of Aquila Tyre Group or its affiliates. WARRIOR, HONSWAY and other brand names shown on the Site are the property of their respective owners and are used with permission.
You may view, download and print pages from the Site for your own internal business reference. Any other use, such as reproducing, republishing or modifying content, or using our trademarks, needs our prior written consent. Authorised distributors may use brand materials as set out in their agreement.
You are responsible for the accuracy of the information you send us through forms, email or WhatsApp. Please do not send confidential or proprietary information through the Site unless we have agreed in writing how it will be handled.
If you send us feedback or suggestions, we may use them without any obligation to you. Personal information is handled as described in our Privacy Policy.
The Site may include links to, or embedded content from, third parties, such as social media feeds, maps and partner websites. We do not control these services and are not responsible for their content, availability or practices. You use them at your own risk and under their own terms.
The Site is provided on an “as is” and “as available” basis. We try to keep information accurate and up to date, but we make no warranties, express or implied, about the completeness, accuracy, reliability or availability of the Site or its content, or that the Site will be uninterrupted or free of errors or harmful components.
Product warranties, where offered, are set out only in the applicable sales contract or warranty document, not on the Site.
To the fullest extent permitted by law, Aquila, its affiliates and their directors, employees and partners will not be liable for any indirect, incidental, special or consequential loss, or for loss of profit, business, data or goodwill, arising from your use of, or inability to use, the Site, or from reliance on its content.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law.
Our Privacy Policy explains what information we collect through the Site and how we use it. It forms part of these Terms.
These Terms are governed by the laws of the People’s Republic of China. Any dispute arising from these Terms or your use of the Site will be submitted to the competent courts of Qingdao, China, unless mandatory law where you are located requires otherwise.
Disputes about the sale of goods are handled as set out in the applicable sales contract.
We may update these Terms from time to time. The updated version will be posted on this page with a new “last updated” date. If you continue to use the Site after a change, you accept the revised Terms.
